This page contains notices specific to software, documents, and links on this web site as well as general legal notices. Design:
Copyright is retained by UBA Solutions on all design work including words, pictures, ideas, visuals and illustrations unless specifically released in writing and after all costs have been settled.

The website, graphics and any programming code remain the property of UBA Solutions until all outstanding accounts are paid in full.

Any scripts, cgi applications, php scripts, or software (unless specifically agreed) written by UBA Solutions remain the copyright of UBA Solutions and may only be commercially reproduced or resold with the permission of UBA Solutions.

UBA Solutions will not be held responsible for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.

The client should provide all materials required to complete the project to the agreed standard and within the set deadline. UBA Solutions will not be accountable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.

UBA Solutions will not be liable or become involved in any disputes (like content or images that have been provided to us for inclusion on the site) between the site owner and their clients and cannot be held responsible for any wrong doing on the part of the site owner.

UBA Solutions will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers, software or any material provided by its agents.

Once a website has been designed and completed the final balance of payment is then due in accordance with our payment terms. There are no exceptions to this, i.e. if the client decides they no longer want the site, as they have commissioned the work and paid a deposit they are still obliged to pay for the work that has been done. Non-payment will result in legal action being taken if necessary. Once full payment is received for a website, it is assumed that the project has been completed to the client’s satisfaction and no refunds can be offered. We do offer free support and maintenance for first 3 months after completion to allow for any final amendments that may be required.

UBA Solutions reserve the right to refuse to handle in any way, material which may be deemed offensive, illegal or in any way controversial.

Database, Application and Ecommerce Development
UBA Solutions will not be responsible for any losses incurred by the use of any software created for the client. Whilst every care has been taken to ensure products are problem free and accurate, the ultimate responsibility lies with the client in ensuring that all software is functioning correctly before use.

Any scripts, applications or software (unless specifically agreed) written by UBA Solutions remain the copyright of UBA Solutions and may only be commercially reproduced or resold with the permission of UBA Solutions.

Where applications or sites are developed on servers not recommended by UBA Solutions, the client is expected to provide or seek any information, additional software, support, or co-operation pertaining to the server required in order for the application to be correctly developed. Where large applications are to be develop, it is the client/s’ responsibility to provide a suitable testing environment which is identical to the final production environment.

The client is expected to test fully any application or programming relating to a site developed by UBA Solutions before being made generally available for use. If bugs, errors or other issues occur after the site is live, UBA Solutions will endeavor (but is not obliged to) to correct these issues to meet the standards of function outlined in the brief.

Website Optimization:
UBA Solutions cannot offer any guarantee regarding the position we will achieve for websites. UBA Solutions will not be liable for any change in rankings or drop off in the position of the websites that might occur due to external factors such as the changes in the way search engines rank websites or changes in the algorithms of the search engines.

UBA Solutions reserve the right to refuse to handle in any way, material which may be deemed offensive, illegal or in any way controversial.

Hosting:
UBA Solutions cannot guarantee the availability or interruption of the services provided by hosting companies. UBA Solutions will not be liable for losses caused by the unavailability, malfunction or interruption of this service or for loss of turnover, sales, revenue, profit or indirect, consequential or special loss.

UBA Solutions reserve the right to refuse to handle in any way, material which may be deemed offensive, illegal or in any way controversial, and also to terminate the free hosting service should the necessity arise.
 

USE OF WEBSITE MATERIAL:

Software:
Any software that is made available to download from this server ("Software") is the copyright work of UBA Solutions and/or its suppliers. Use of the Software is governed by the terms of the end user license agreement that accompanies or is included with the Software ("License Agreement").

The Software is made available for downloading solely for use by end users according to the License Agreement. Any reproduction or redistribution of the Software not in accordance with the License Agreement is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.

In no event shall UBA Solutions and/or its respective suppliers be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, date or profits, whether in an action of contract, negligence or other tortuous action, arising out of or in connection with the use or performance of software, documents, provision of or failure to provide services, or information available from this server.

For information concerning permission to donate or transfer software product, software licenses, or hardware loaded with UBA Solutions to another party, please contact us.

Documents:
Permission to use Documents (such as white papers, press releases, datasheets and FAQs) from this server ("Server") must be obtained first by sending a request to info@uba-solutions.com . Violators will be prosecuted to the maximum extent possible.
In no event shall UBA Solutions and/or its respective suppliers be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, date or profits, whether in an action of contract, negligence or other tortuous action, arising out of or in connection with the use or performance of software, documents, provision of or failure to provide services, or information available from this server.

PAYMENT:

It is required that any new client pay the deposit before any work is carried out. All the outstanding accounts for work carried out by UBA Solutions are required to be paid in full, no later than 30 days from the date of the invoice unless prior arrangement with UBA Solutions.

Once the deposit is paid and work completed, the client is obliged to pay the balance of payment in full. UBA Solutions will contact clients via email, telephone or other means of communication as a reminder of such payments if they are not received when due.

If accounts are not settled or UBA Solutions has not been contacted regarding the delay, access to the related website/software or other projects may be denied and/or removed. We will then pass such cases to the Small Claims Court to pursue payment, non-payment can result in country court judgment being added to the clients’ credit rating.

Following consistent non-payment of an invoice our Solicitors will contact the client in question, with a view to taking the matter further and if need be to seek payment through legal procedures, and if necessary court summons.

YOUR PRIVACY

UBA Solutions does not share or sell any of the details provided by the client with third party companies without the client’s permission and UBA Solutions will only email or contact the client about work related matters.
